Terms of Service

These terms govern your use of Capvisor. By creating an account you agree to them.

1. What Capvisor is
Capvisor is accounting software. It records your business transactions, reads your receipts and statements, and produces financial statements, reports and analysis.
Capvisor is a tool, not an accountant. It does not provide accounting, tax, legal or financial advice. Nothing it produces is a substitute for a qualified professional, and you remain responsible for the accuracy of your own books and for what you file with the Kenya Revenue Authority or give to a lender.
2. Your account
- You must be 18 or over and authorised to act for the business you register.
- Give us accurate details and keep them current.
- Keep your password to yourself. You are responsible for what happens under your account.
- Tell us promptly if you believe someone else has access.
- One account is for one person. Do not share logins.
We may suspend or close an account that breaks these terms, is used unlawfully, or is used in a way that threatens the service for others. Except in urgent cases we will tell you first and give you a chance to put it right.
3. Subscriptions and payment
Plans. Capvisor Basic and Capvisor Pro, with optional add-ons. Current prices are shown in the app before you buy and are in Kenyan Shillings.
Billing. Subscriptions are monthly, in advance, and renew automatically until cancelled. Payment is by M-Pesa or card through Paystack. You authorise us to charge your chosen method on each renewal date.
Missed payment. If a payment fails you get a seven-day grace period with full access while we retry and remind you. If it is still unpaid at the end of day seven, access is locked. Your data is not deleted — pay and it is restored immediately.
Cancelling. Cancel any time in the app. You keep access to the end of the period you have paid for. We do not pro-rate part months.
Refunds. Monthly subscriptions are not generally refundable, because the service was available for the period charged. If Capvisor was substantially unavailable through our fault, or you were charged in error, contact us — we will put it right.
Price changes. We will give at least 30 days' notice before any price increase. If you do not accept it, cancel before it takes effect.
Taxes. Prices include VAT where applicable. You are responsible for any other taxes on your own business.
4. Your data is yours
You own your business records. You grant us only the licence needed to run the service for you: to store, process, display and back up your data, and to send documents to the processors named in our Privacy Policy so they can be read.
We do not sell your data. We do not use it to train AI models without your explicit, separate consent.
You can take it with you. Settings → Security → Download all my data, at any time, in a machine-readable format, at no charge.
5. What you must not do
- Upload anything unlawful, or anything you have no right to upload.
- Upload material designed to damage or compromise the service.
- Attempt to access another business's records.
- Reverse-engineer, resell or white-label Capvisor without our written agreement.
- Use automated tools to place unreasonable load on the service, or to work around usage limits.
- Use Capvisor to launder money, evade tax, or misrepresent your finances to a lender.
6. Availability
We aim to keep Capvisor available, but we do not guarantee uninterrupted service. We may take it down for maintenance, and will give notice where we reasonably can.
We depend on third parties — hosting, AI processing, payments, connectivity. An outage at one of them may interrupt Capvisor, and we are not liable for their failures beyond our reasonable control.
7. Accuracy — please read this one
Capvisor reads documents automatically and produces figures, statements and analysis from them. This is not perfect. Optical character recognition misreads. Automatic categorisation guesses. Written summaries are generated by AI and can be wrong.
You must check the figures. Before you file a tax return, apply for credit, or make a decision on what Capvisor shows you, verify it against your own documents. Capvisor highlights what it is unsure about, but it cannot flag a mistake it does not know it made.
Loan readiness is an estimate for your own information. It is not an application, not an offer, and no lender sees it. We do not send your data to any lender.
8. Liability
Nothing here excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud.
Subject to that, and to the extent the law allows:
- Capvisor is provided as is, without warranties beyond those the law implies.
- We are not liable for indirect or consequential loss, lost profit, lost business, or lost goodwill.
- We are not liable for tax penalties, rejected loan applications, or decisions you make on figures you did not verify.
- Our total liability in any 12-month period is limited to what you paid us in that period.
This reflects that Capvisor is inexpensive software, not an insured professional service. If you need assurance on your accounts, engage a qualified accountant.
9. Ending the agreement
You may cancel or delete your account at any time.
We may end it if you materially break these terms, if your subscription goes unpaid beyond the grace period, or if we discontinue the service — in the last case, with at least 60 days' notice and a refund of any period paid for and not used.
On termination: your access ends, and your data is deleted as described in the Privacy Policy, subject to records we are legally required to retain. Download your data first.
10. Changes to these terms
We may update these terms. Material changes will be notified in the app, and you will be asked to accept them before continuing. Minor clarifications may be made by posting the revised version here.
11. Law and disputes
These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction.
Before going to court, please contact us at info@capvisortech.com. Most problems are faster to fix than to litigate.
12. General
- If any provision is unenforceable, the rest still stands.
- Not enforcing a right once does not waive it.
- You may not transfer these terms to anyone else. We may transfer them to a successor of our business.
- These terms and the Privacy Policy are the whole agreement between us about Capvisor.

A note on this draft. These terms were written to describe accurately how Capvisor actually works — its billing, its grace period, and the real limits of automatic document reading. They have not yet been reviewed by an advocate. Capvisor should have them checked before charging customers. They are published now rather than left as a placeholder, because taking money against no terms at all is the worse position.
